Bayer is arguing that United States federal law preempts state-level failure-to-warn claims since the country’s Environmental Protection Agency (EPA) has supposedly found no cancer risk from glyphosate and does not require any such warning label to be placed on the weedkiller. The company previously attempted this legal route in 2022 but was turned down. However, observers believe a more recent split among federal appeals courts may now increase the chances of the U.S. Supreme Court taking up the case.
This latest petition arises from a 2023 case in which a Missouri jury awarded $1.25 million to plaintiff John Durnell. Bayer faces ongoing legal and financial challenges, including approximately 67,000 pending Roundup-related lawsuits, and reportedly has $5.9 billion set aside for future legal costs. The company has already spent around $10 billion settling similar claims and recently lost a $2.1 billion verdict in Georgia. Significantly, therefore, since its disastrous acquisition of the Monsanto company – the original producer of Roundup – for $63 billion in 2018, Bayer’s stock price has crashed by over 70 percent.

Seeking to avoid potentially billions of dollars in damages, Bayer says it is again petitioning the United States Supreme Court to sharply limit legal claims that its glyphosate-based weedkiller Roundup causes cancer.
